Selling Only Authorized Products!
Lollipop Sports, like many lawful retailers, sells only authorized, licensed products. We purchase the products, pay for them in a timely manner and proudly sell them in their original format (we do not modify or reproduce any part of the product) and deliver extraordinary service to the many consumers who purchase our products which we rightfully own.
The United States Supreme Court has ruled that people who legally own a product may legally resell it, and federal law protects that right under the first sale doctrine. The first sale doctrine, codified at 17 U.S.C. § 109, provides that an individual who knowingly purchases a copy of a copyrighted work from the copyright holder receives the right to sell, display, or otherwise dispose of that particular copy, notwithstanding the interests of the copyright owner who gives up their copyright to individual copies of a work once it is sold.
Section 109(a) restates and confirms the principle that, where the copyright owner has transferred ownership of a particular copy or phonorecord of a work, the person to whom the copy or phonorecord is transferred is entitled to dispose of it by sale, rental, or any other means. Under this principle, which has been established by the court decisions and section 27 of the present law [section 27 of former title 17], the copyright owner’s exclusive right of public distribution would have no effect upon anyone who owns ‘‘a particular copy or phonorecord lawfully made under this title’’ and who wishes to transfer it to someone else or to destroy it.
